Wrongful Death Attorneys

A family who has suffered the wrongful death of a loved one in Texas is well-advised to seek the professional capabilities of a seasoned Austin wrongful death attorney for a number of reasons.

Often a family will be approached soon by a representative of the defendant in the form of an insurance adjuster or defense attorney.

Their goal is to monetarily ‘settle’ any issues surrounding the death. Their timing is often during a period of shock and grief in which the family is unable to make intelligent, reflective decisions that are in the best interest of the survivors. It is standard for them to under-evaluate the case for an amount of money that is much less than a settlement that could be reached in court.

The insurance companies are usually much more aware of the policy limits and the real value of a claim than a plaintiff. Too, it is in the insurance company’s best interest in very serious accident cases to establish rapport with the victim’s family and leave the impression that the insurance company will be fair and provide adequate compensation to the family.  In essence, indirectly discouraging the family from involving attorneys.

Obviously, there’s a reason that insurance companies often use this tactic.  Insurance companies do not want high-powered attorneys representing the victims family because such law firms have a good understanding of the true value of a wrongful death case in the particular jurisdiction.

If there are survivors – the insurance companies will also be swift in seeking a settlement to avoid larger awards for long-term and/or permanent injuries that may not present immediately. The more serious the case, the more likely the insurance company is to contact the family or the innocent victim and try to “comfort them”.  If the insurance company does not perceive significant exposure that same family or innocent victim will not get the time of day from the insurance company in a typical case.  A general rule of thumb is the more friendly and helpful the defendant’s insurance company is the more you probably need an attorney to help you.

Plaintiffs in a wrongful death suit or claim are well serving their interest to retain legal representation. This does not mean that a suit will reach a courtroom – but it does ensure that they have an attorney looking out for their best interests and not the insurance companies.
