Breathalyzers and their results are a very controversial subject. Criminal Defense attorneys regularly make claims that they are nothing short of ‘bogus’, unreliable and invalid and their findings should not be the basis of an arrest or prosecution. What follows are some simple facts about breathalyzers.

*A breathalyzer is a device for estimating blood alcohol content (BAC) from a breath sample.

*Law enforcement officers use breathalyzers to test the level of alcohol concentration in a person’s blood. This is thought to be an effective tool to determine if people are driving under the influence of alcohol.

*Breathalyzers provide almost instant results of Blood Alcohol Content (BAC).

*Items such as pennies, mints and mouthwash will not throw off a breathalyzer or otherwise ‘trick’ the device.

*Breathalyzer results are NOT one hundred percent accurate – even though the technology supposedly continues to improve with each new version of the machine.

*They are now portable – small in shape and easy to use – so they are now an attractive purchase for people to possess one and use in places like law organizations, home, schools, and offices, etc.

*It is not true that breathalyzers directly measure blood alcohol content or concentration in a person’s blood stream. Instead they measure the alcohol content in a person’s breath and estimate his or her BAC at a reasonable accuracy.

The bottom line about breathalyzers is that IF a police officer has pulled you over and asked you to take a breathalyzer test – you are probably in a bit of a jamb.
